The highest court in America cannot agree on the most basic words in the English language. Last week’s Supreme Court decision in West Virginia v. B.P.J. was widely reported as 6-3, based on its decision over whether a state may legally require student athletes to compete against members of their biological sex. Reading the opinions in the case reveals a deeper split, and no, it’s not the fact that the liberal justices agreed with the majority’s holding. It’s a division that breaks down into a three-way split, and it comes over the proper use of two simple everyday words: him and her.

It’s a Looney Tunes world of pronoun trouble at the Court, with an easy fix.
