The Roberts Court Should Expand its Rulings in Mahmoud and Mirabelli
Parental rights predate the Constitution’s drafting, yet today they are often treated as little more than footnotes in court. The Roberts Court has taken steps to strengthen parental rights arguments recently, and it should continue to build on those steps until parental rights regain the power they have historically held. The pending Amish challenge to New York’s school vaccine mandate in Miller v. McDonald offers the ideal vehicle to do so.
